L853 NOTICE OF MORTGAGE FORECLOSURE SALE STATE OF ALABAMA COUNTY OF BARBOUR Default having been made of the terms of the loan documents secured by that certain mortgage executed by Kimberly D Jones Wife Terrell Jones Husband to Conseco Bank, Inc. dated March 16, 2000; said mortgage being recorded on June 12, 2000, in Book E215, Page 322 in the Office of the Judge of Probate of Barbour County, Alabama. Said Mortgage was last sold, assigned and transferred to U.S. Bank National Association, as Trustee, for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 2000-2 by assignment recorded in Deed Book 365, Page 552 in the Office of the Judge of Probate of Barbour County, Alabama. The undersigned, U.S. Bank National Association, as Trustee, for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 2000-2, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Barbour County, Alabama during the legal hours of sale (between 11am and 4pm), on the 10th day of June, 2020 the following property, situated in Barbour County, Alabama, to-wit: All that tract or parcel of land located in the West Half of the Southwest Quarter of Section 12, Township 12 North, Range 29 East, Barbour County, Alabama. Being the North Half of the North Half of Tract 2 as shown on the plat of survey of the Chauncey Dean Taylor Lands prepared by Barren & McPherson, Inc, dated 10 November, 1992, and being more particularly described as follows: Starting at the Southwest corner of Section 12, Township 12 North, Range 29 East, Barbour County, Alabama go along the South line of said Section 12 South 88 degrees 20 minutes East 8.38 feet, thence North 28 degrees 14 minutes East 900.8 feet to the POINT of BEGINNING, thence continue North 28 degrees 14 minutes East 120.6 feet; thence South 63 degrees 45 minutes East 312.5 feet to the West right of way of Alabama Highway 165; thence along the West right of way of Alabama Highway 165 South 26 degrees 15 minutes West 120.55 feet; thence North 63 degrees 45 minutes West 316.67 feet to the POINT of BEGINNING. Said property is commonly known as 724 Hwy 165 N, Eufaula, AL 36027. Should a conflict arise between the property address and the legal description the legal description will control. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above.
