Default having been made in the payment of the indebtedness described in and secured by that certain Deed to Secure Debt executed by Leigha Shae Ward and John Travis Ward to FRANCES DARLENE FORD ST. MARTIN and ANTHONY FREDERICK ST. MARTIN dated the 4th day of August, 2015, and recorded the 7th day of August, 2015 in Deed Book 115 at Pages 219-223 in the Office of the Clerk of the Superior Court of Quitman County, Georgia, conveying the after-described property to secure a Note in the amount of FORTY-SEVEN THOUSAND Dollars and 00/100 ($47,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash during the legal hours of sale on the first Tuesday in January, 2020, before the Courthouse door of Quitman County, Georgia the following described real property: All that certain tract or parcel of land being specifically designated as Lot 11 of William A. Toms Subdivision situate, lying and being in Land Lot 292 of the 8th Land District of Quitman County, Georgia and being further identified as having such shape, size, metes and bounds, courses and distances as are shown upon that Plat of survey by Timothy W. Simpson, Georgia Registered Land Surveyor No. 2812 for "Warren R. and Darlene Dixon" dated the 15th day of December, 2005 and recorded in Plat Book/Cabinet A63 at Page 6A in the Office of the Clerk of Superior Court for Quitman County, Georgia. Reference is hereby made to said plat and incorporated herein for the purpose of a more particular and accurate description of the property herein conveyed. Subject to easements and restrictions of record, including laws, ordinances and regulations regulating the use of the conveyed property. This being the same property as described in that certain Special Warranty Deed from JP Morgan Chase Bank as Trustee by Residential Funding Corporation as Attorney in Fact to Warren R. Dixon and Darlene F. Dixon dated the 15th day of December, 2005 and recorded the 20th day of December, 2005 in Deed Book 94 at Pages 420-421 in the Office of the Clerk of the Superior Court of Quitman County, Georgia. The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Deed to Secure Debt and by law, including attorney fees (notice of intent to collect attorney fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, not yet due and payable), any matters which might be disclosed by an accurate survey and by an inspection of the property; any assessments; liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above.
